User Obligations

The sale of beverage alcohol is heavily regulated. You are responsible for compliance with all applicable laws, particularly in connection with the shipment of alcohol, applicable to purchasers and consumers of alcohol. Mazel Tov Wines may not ship alcohol outside of the province of Ontario and you will make no requests to the contrary. You agree not to do any of the following whiles using the Website:

• Intentionally or unintentionally violate any applicable law or regulation including making an offer to purchase or delivery arrangement for wine by or on behalf of a person not of legal drinking age.

• Access, tamper with or use non-public areas of the Website or Mazel Tov Wines ' computer systems.

• Frame or link to the Website except as permitted in writing by Mazel Tov Wines .

 

The Sale of Alcoholic Beverages

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

Communicate with you; Screen our orders for potential risk or fraud; and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

 

How We Operate

Mazel Tov Wines is an appointed vendor of Sacramental wines by the Liquor Control Board of Ontario (LCBO). Mazel Tov Wines customers acknowledge that he/she has read, understands, and agrees with the following terms and conditions agree to the following: 1. that the Purchaser is a person authorized to preside at religious ceremonies or is an authorized representative of such a person. 2. that the Purchaser is acquiring the Product(s) to be used only for sacramental purposes in religious ceremonies conducted by a person or persons authorized to preside at such ceremonies in a regular place of worship, such as a church, temple or synagogue; 3. that the Sacramental Wine Vendor is authorized to sell the Products to the Purchaser, only for use in religious ceremonies and that the Purchaser is aware that it is unlawful for the Purchaser to resell the Products or use the Products at any social events or occasions associated with or ancillary to religious ceremonies including, without limitation, wedding receptions, baptisms, confirmations, first communion celebrations, bar/bah mitzvahs and ordinations. Wine acquired for consumption at social events or occasions including those associated with or ancillary to religious ceremonies such as wedding receptions, baptisms, confirmations, first communion celebrations, bar/bah mitzvahs and ordinations must be purchased directly from the LCBO; and 4. that the Purchaser agrees that upon request of the LCBO, the Purchaser will provide satisfactory evidence to the LCBO, that the Purchaser has complied fully with these terms and conditions.

 

Sharing Your Personal Information

Mazel Tov Wines does not process the sale of wine and spirits to persons under the age of 19. By using this site you swear and affirm that you are age 19 or over. Mazel Tov Wines make every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 19. By using the Website you are acknowledging that the person receiving a shipment of alcoholic beverages from Mazel Tov Wines is 19 years of age or more. If you do not agree with these conditions of use you are prohibited from using the Website. If you intentionally or unintentionally misrepresent your age to provide alcohol to a person under the age of 19, Mazel Tov Wines will report the infraction to the AGCO which may prosecute you fully to the extent allowable by law.

Upon delivery, proof of age may be required at the discretion of the delivery agent. The delivery agent will not complete the delivery of wine or spirits to any person who appears intoxicated.

Note, that you are not permitted to sell wine except in accordance with AGCO regulations. If you intend to sell wine for profit for consumption or otherwise, you may only do so under a liquor license issued by the AGCO. If you intend to sell wine for consumption or otherwise at occasional special events only held outside a residence (a “Sale SOP”), or to provide for the consumption of wine at an indoor or outdoor event open to the public (a “Non-Sale SOP”) you may only do so under a Special Occasion Permit (“SOP”) issued by the AGCO. IT IS ILLEGAL TO SELL WINE IN OR FROM A PRIVATE RESIDENCE. When selling or providing for the consumption of wine under a liquor license or SOP, you are responsible for the safety and sobriety of the people attending the event as well as for compliance with all applicable laws and regulations.

 

Third-Party Content and Monitoring

Any opinions, advice, statements, services, offers, events or other information or content expressed or made available on this Website by third parties (including information providers and users) are those of the respective author(s) or distributor(s) and not of Mazel Tov Wines . Mazel Tov Wines neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on this Website by anyone other than authorized Mazel Tov Wines employees acting in their official capacities.

Termination of your Mazel Tov Wines Account

Termination of your Mazel Tov Wines account includes removal of access to all wine offerings and use of the Website. Furthermore, you agree that all terminations shall be made in Mazel Tov Wines ´ sole discretion and that Mazel Tov Wines shall not be liable to you nor any third party for any termination of your account or access to the Website.

 

Force Majeure

Mazel Tov Wines shall be excused from performance under this Terms of Service if Mazel Tov Wines is prevented, forbidden or delayed from performing, or omits to perform, any act or requirement under this Terms of Service because of: (a) any provision of any present or future law or regulation, (b) any act or omission of a third party, or (c) any act of God, emergency condition, war, computer or telecommunications failure or other circumstance beyond the control of Mazel Tov Wines .
